What Philanthropy Needs to Know about Nondiscrimination Protections for LGBTQ People, the Supreme Court, and Title VII

Today the Supreme Court of the United States hears oral arguments on three cases which will decide whether or not lesbian, gay, bisexual, transgender, and queer people are protected from employment discrimination under existing law (Gerald Lynn Bostock v. Clayton County, Georgia; Altitude Express v. Melissa Zarda; and R.G. & G.R. Harris Funeral Homes v. Equal Employment Opportunity Commission). The Court is being asked whether Title VII of the Civil Rights Act of 1964, which prohibits discrimination based on sex, includes LGTBQ people. How Philanthropy Can Respond to the Trump Administration’s Latest Attacks on the Trans Community

Last week the Trump Administration announced two policy changes that jeopardize the health and wellbeing of transgender people across the nation. Last Friday, the Department of Health and Human Services (HHS) proposed rolling back existing protections enacted under the Affordable Care Act (ACA) that prohibit companies, hospitals, doctors, and nurses from discriminating against transgender patients. The day before, the Department of Housing and Urban Development (HUD) proposed new policies to reverse the 2012 Equal Access Rule that ensured homeless shelters could not refuse services to people based on their gender identity. Who Made the 2016 Trans Funding Honor Roll?

In 2016, 115 U.S.-based foundations awarded nearly $17 million dollars to trans communities in the United States, representing a 22 percent increase from 2015 and a record high mark in funding for trans communities.
